SS 50: Irrigation Partnership (Musaqat)
What this standard is about
Musaqat is a traditional farming partnership. One side owns trees that produce edible fruit, such as date palms or orange trees. The other side does the work: watering, pruning, fertilizing, and caring for the trees. In return, the worker gets an agreed share of the fruit.
The standard sets the conditions for this partnership so that both sides know their rights. It is the sister contract of muzara'ah (sharecropping). The difference is simple: muzara'ah is about open land that must be planted and cultivated from the start, while musaqat is about trees that already exist and need care.
Why it exists
Farming partnerships like this have existed since the earliest days of Islam and are mentioned in the prophetic tradition. They let a landowner who cannot do the work and a worker who owns no land both benefit. Because modern Islamic banks and funds sometimes finance agriculture, AAOIFI wrote a standard so these deals follow clear, agreed rules instead of local guesswork.
The key rules, simply put
- The trees must be identified and must produce edible fruit.
- The worker's job is the care of the trees, mainly irrigation, plus work like pruning and pest control.
- The fruit is shared in a defined common share agreed in advance, for example one-third to the worker and two-thirds to the owner.
- The contract runs for an agreed period or season and ends when the produce is harvested and divided, or when the agreed time passes.
- The worker is entitled to his agreed share of the fruit that actually grows.
- If the arrangement turns out to be invalid, a worker who did the work in good faith is still paid the normal going wage for such work, capped at the share he was promised.
An everyday example
A retired man owns a small orange orchard but cannot maintain it. He agrees with a young farmer: the farmer will water, prune, and care for the trees for one season, and they will split the oranges half and half. When the harvest comes, each takes his half. That is musaqat.
